Further to their decision dated 3 March 2009 relating to the publication of an increased number of documents from the judicial investigation, by virtue of Rule 56(2) of the ECCC Internal Rules, the Co-Investigating Judges have decided to make public a set of Case File documents relating to the issue of the possible use, during the current proceedings, of confessions obtained under torture during the Democratic Kampuchea regime. The documents include, in particular:

– the original request by a defence team to exclude such confessions, dated 11 February 2009; and
– a response by the Co-Prosecutors, dated 30 April;
The Judges’ order will also be published.

The set of these documents may be accessed by clicking on: http://www.eccc.gov.kh/english/court_doc.list.aspx?courtDocCat=case_docs, then typing into the “Search doc no. :” field, the Case File reference: “D130”.

This publication will be followed by others at regular intervals. The Co-Investigating Judges also recall that the Court Report, published on the ECCC website, contains a monthly update of current activity in the judicial investigation: http://www.eccc.gov.kh/english/publications.courtReport.aspx.
